Cardholder Terms and Conditions
1. Definitions
In these Terms and Conditions:
- "Ultimate Supporter Card" is a Swipecard Cashback enabled card (standard or branded).
- "Ultimate Supporter" is a person who possesses and uses an Ultimate Supporter Card.
- "Hardcard" is a Canterbury University Student Swipecard Cashback enabled card.
- "Swipecard Ltd or Swipecard" is the company that operates the Swipecard Cashback Platform.
- "Cashback Platform" is a technical and software system designed by Swipecard to allow the Swipecard Cashback to function.
- "Swipecard Cashback or Cashback" is the act of transferring Cashback Reward Dollars through a Cardholders plastic card via an Eftpos terminal or similar.
- "Cashback Reward Dollars" equates to real money with $1 Cashback equaling $1 in New Zealand currency.
- "Cashback Programme" means being part of or using a card as deemed in these Terms and Conditions.
- "Cardholder" means an individual who possesses and uses any Swipecard Cashback card.
- "Card" is any Swipecard Cashback enabled card.
- "Non Profit Organisation" is a charity, school, sports club or organisation that mets that classification from the Inland Revenue Department and is a beneficiary of the donation component of the Cashback Reward Dollars allocated by an individual Cardholder.
- "Merchant" means any retailer or other business that is a participating business of the Swipecard Cashback programme and has the ability to redeem and/or allocate Cashback Reward Dollars.
- "Cardholder Account" is the account in which the Cardholder accrues Cashback Reward Dollars.
2. Acceptance
By using any Swipecard Cashback enabled card such as, but not limited to, the Ultimate Supporter Card or Hardcard, you accept and agree to these Terms and Conditions.
3. Participation
Obtaining a card is free from most participating merchants.
Participation as a Cardholder consists of presenting the Card when making purchases for goods or services at participating merchants to accumulate and/or redeem Cashback Dollars.
By participating as a card user, the Cardholder:
- agrees to comply with these Terms and Conditions, as varied from time to time; and
- gives their consents in Section 6; and
- must notify immediately of any change of address or if a card is lost or stolen.
In the event that a Card is lost and a replacement Card is requested, Swipecard may at its discretion charge a reasonable fee for the replacement Card. This covers fee transferring Cashback balances and administration.
Swipecard may terminate the use of a Card, without notice and for any reason, including if the Cardholder:
- fails to comply with these Terms and Conditions; or
- supplies any misleading information or makes any misrepresentations to Swipecard or to any other connected party in the Cashback Programme; or
- abuses or fraudulently uses any part of the Cashback Programme; or
- dies or becomes bankrupt; or
- has not used his or her card for a period of two years.
If a Card has not been used by the Cardholder to accumulate or redeem Cashback Dollars for a continuous period of two years, the Card will be deemed inactive and its use will be terminated.
A Cardholder may at any time terminate his or her card by giving written notice to Swipecard.
Any tax arising from a Cardholder's participation in the Cashback programme is the responsibility of the Cardholder.
4. Collecting Cashback Dollars
Cashback Reward Dollars will be allocated to the Cardholder’s Cashback Account for purchases made by the Cardholder for goods or services from a participating Merchant.
Merchants offer Cashback Reward Dollars either store wide or on specific items or value.
A minimum Cashback Reward amount is $1 and can be several hundred dollars depending on the purchase. A small single fixed transaction fee applies to each purchase (see Section 7: Fees).
Cardholder can start collecting Cashback Dollars immediately and this is transacted via the Merchants Eftpos machine.
Cardholders can continue to collect Cashback Dollars but to spend Cashback Dollars, the Cardholder must first register their Card via the appropriate website (see Section 5: Card Registration).
In order to receive Cashback Dollars, a Cardholder must notify the participating Merchant before the transaction is concluded that they are a Cardholder. This may be done verbally or by presenting the Card.
When a Cashback transaction is processed in a Merchant’s Eftpos machine, a receipt will be printed showing the purchase amount and the balance of Cardholder Cashback Dollars available in the Cardholder’s Account (depending on the Eftpos machine type). This receipt should be retained by the Cardholder to verify that the transaction has been processed.
Cashback Reward Dollars allocated through Eftpos transactions will be allocated to the Cardholder’s Cashback Account immediately.
Every time Cashback Reward Dollars are allocated to a Cardholder, Reward Dollars are also allocated to Non Profit Organisations as setup by the Cardholders.
5. Card Registration
Cardholders need to register their card on the appropriate website before they are able to spend their Cashback Reward Dollars.
Cardholders must provide basic details and also set their donation amounts for their chosen Non Profit Organisations. The default setting for the default Non Profit Organisation is a minimum of 15% unless changed by the Cardholder. Several Non Profit Organisations can be choosen but the maximum total is 50% of the Cashback amount received by the Cardholder.
Cardholders can login in via their card number or email address plus their password at any time to check balances, transaction, personal details and donation amounts.
It is the responsibility of the Cardholder to keep registration details up-to-date.
6. Spending Cashback Dollars
Cashback Reward Dollars that have been accumulated in the Cardholder's Account may be spent with any participating Merchant via the EFTPOS system as whole or part payment for goods or services sold by that Merchant.
Cashback Dollars are redeemable by the Cardholder at the rate of NZ$1.00 per Cashback Dollar held in the Cardholders Account.
The Card must be presented and swiped through the Merchant's Eftpos machine to process the purchase.
When the transaction is processed, the Cashback Dollars spent will be instantly deducted from the Cardholder's Account and at the same time, if there is a Cashback Reward amount associated with that purchase, the Cardholder will also be allocated the Cashback Reward Dollars associate with that purchase.
The amount of Cashback Dollars redeemed cannot exceed the total amount of Cashback Dollars in the Cardholder's Cashback Account.
Cardholders are unable to withdraw any of their Cashback Dollars in cash by any means and the Cashback Dollars must be used only for purchases.
7. Fees
A single transaction amount of 50 cents will be taken form every purchasing transaction (where the Cardholder receives a Cashback Reward amount). This transaction fee is the same regardless of the Cashback Reward amount the Cardholder receives.
A small administration fee of 50 cents will be taken from the Cardholders Account each month to cover company administration fees. If the Cashback Account balance is less than 50 cents, the amount will accrue each month until the administration fee can be taken.
Merchants may also deduct from the Cashback Dollars from a Cardholder's Account:
- any Cashback Dollars recorded in error; and
- any Cashback Dollars relating to a transaction which has been cancelled or where a refund has been given.
8. Personal Information
Information about Cardholders (whether provided by Cardholders directly to Swipecard, or by Merchants about Cardholder transactions) will be collected and held by Swipecard.
This information will be used by Swipecard to provide services relating to the Swipecard Programme. Information from the database will also be used by Swipecard, and its agents, for marketing purposes, planning, product development and research.
Each Cardholder consents to the collection and use of their personal and other information in the manner set out above and the disclosure of such information to Swipecard agents, Merchants and associate parties for the purposes of operating the Swipecard Programme. Information about Cardholders may be disclosed to a Merchant or associated party if:
- Swipecard considers on reasonable grounds that the Cardholder may have been involved in fraudulent activities in relation to that Merchant or associate party; or
- the relevant Cardholder consents in writing; or
- Swipecard considers on reasonable grounds that the disclosure is necessary to enable the recording of Cashback Reward Dollars in relation to transactions of those Cardholders; or
- the Cardholder is a prize winner in a competition or promotion run by or on behalf of a Merchant or associate party and the information is disclosed for the sole purpose of enabling notification of the prize winner and/or making arrangements for receipt of the prize.
Information about members will not be provided by Swipecard to any person except as provided in this Section 6 or permitted by the Privacy Act 1993.
Cardholders may, under the provision of the Privacy Act 1993, request access to and correction of their information held by Swipecard. These requests must be made in writing as per Swipecard contact information (see Section 11 : Contact Information).
9. General
Cards are not transferable and are the property of Swipecard.
Swipecard Reward Dollars, and any rights they confer, cannot be sold, transferred, assigned to or otherwise dealt with except in accordance with these Terms and Conditions.
The current version of these Terms and Conditions will be maintained on the website and Swipecard recommends that Cardholders review this from time to time for changes. Swipecard is not obligated to notify Cardholders of any changes.
Swipecard may change, at any time and without prior notice, these Terms and Conditions, the rewards available to Cardholders and/or the participating Merchants and associated parties. Swipecard may make that change even if it has the effect of reducing or extinguishing the number or value of, any existing or future Swipecard Reward Dollars.
Swipecard reserves the right to suspend or terminate the Programme at any time without prior notice.
10. Disclaimer
Swipecard is not the issuing company of Cashback Reward Dollars and is not liable for the failure or otherwise, should participating Merchant default on their Cashback obligations.
Swipecard is not liable for:
- any delay in replacing a Card;
- any unauthorised use of a Card;
- any delay by or failure of a Merchant to notify Swipecard of the details of a transaction;
- any failure by a Merchant or associate party to meet the terms and conditions on which it has agreed to participate in the Programme;
- the suspension and/or termination of the Programme.
A notice will be deemed to be given to a Cardholder if it is posted or emailed to the address of the Cardholder appearing in the Swipecard records.
All conditions and warranties, whether express or implied and whether arising under legislation or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the Swipecard Programme are expressly excluded to the full extent permitted by law.
Swipecard provides the Programme for Merchants and associate parties and each exclusion or limitation of liability in these Terms and Conditions also applies to each of those organisations and their employees and agents.
Swipecard will take all reasonable care to ensure that information it publishes is accurate, but does not accept any liability relating to information provided by third parties.
Merchants and associated parties do not have any authority, express or implied, to make any representation, warranty or statement on behalf of Swipecard.
